Australia Post ordered to pay compensation to a courier who was racially abused by a manager
AUSTRALIA Post has been ordered to pay compensation to a courier who was called a “f---ing black b-----d” by a manager.
Viswanathan Murugesu took legal action against Australia Post after being racially abused by senior manager John Boyle while working as a subcontractor between 2008 and 2011.
He was routinely referred to as a “f---ing black b-----d”, was told by a manager to “kiss my white a---” and was told his people “should be wiped out”.
Last Thursday, he was awarded $40,000 by the Federal Court, and is now preparing to sue Australia Post in the Supreme Court.
Mr Murugesu says he was left with significant psychological injury after being racially abused by Mr Boyle.
In a damning Federal Circuit Court judgment handed down last year, the organisation was slammed for failing to act to stamp out the scourge.
Mr Murugesu told the court Mr Boyle racially vilified other drivers but complaints fell on deaf ears.
Last year, an Aboriginal worker in NSW alleged he was the victim of ongoing abuse, claiming he was told: “All black people should be hung up by the throat and shot.”
Arnold Thomas and Becker’s Joseph Ridley, who represented Mr Murugesu, said the payout was justified because of Australia Post’s failure to act.
“I believe it is the highest award of damages ever awarded for a verbal racial discrimination case,” Mr Ridley said.
“Racism in any form is completely unacceptable anywhere. Racism in a workplace such as Australia Post is appalling, but the failure of Australia Post to take any action or to take my client’s complaints seriously is inexcusable.”
Mr Ridley said it was disappointing Australia Post had denied Mr Murugesu was the victim of any racial vilification.
“Australia Post did so knowing that our client suffers from a very significant psychological injury, for which we will be bringing a further claim for damages against Australia Post in the Supreme Court,” he said.
“Australia Post had many opportunities to settle the matter, but refused to acknowledge the reality of the very serious findings of the court.”
Mr Boyle no longer works with Australia Post.
